You Can’t Fire Me — I Quit: Special Counsel Jack Smith Retiring Before Trump Takes Office: Report

According to a New York Post report, special counsel Jack Smith, who oversaw Donald Trump’s federal criminal cases on overturning the 2020 election and hoarding classified documents, is expected to retire before Trump takes office in January. Trump has said he would fire Smith in “two seconds.”

From The New York Post:

He intends to finish his work before Trump regains power and goes after those who brought criminal charges against him.

The DOJ has a longstanding policy of not prosecuting a sitting president and officials there reportedly are aware it would be futile to continue pursuing charges.


Prior to winning re-election, Trump was asked during an interview with conservative radio host Hugh Hewitt about what he would do about Smith.

“It’s so easy. I would fire him within two seconds,” Trump responded. “He’ll be one of the first things addressed.”

Trump has frequently referred to Smith as a “crooked person.”

Smith’s office is still deciding how to wind down the cases against Trump.
