Anthony Fauci Takes the Fifth 111 Times During Senate Hearing

Dr. Anthony Fauci invoked his Fifth Amendment rights more than 110 times during Wednesday’s Senate hearing, refusing to answer Republican lawmakers on the origins of COVID-19, funding for research in Wuhan, his communications with former NIAID adviser David Morens, EcoHealth Alliance, federal recordkeeping, and his handling of the pandemic.

To every question, the answer was the same: “On the advice of counsel, I respectfully decline to answer based upon my rights under the Fifth Amendment to the Constitution.”

It didn’t end there. At the close of the hearing, committee Chairman Sen. Rand Paul (R-Ky.) announced that the panel will vote next week on a resolution to hold Fauci in contempt of Congress.

Paul’s argument: the privilege doesn’t apply. Fauci already has a presidential pardon, Paul said, and can’t claim protection from self-incrimination for something he’s already been forgiven for. “Because you refused to answer citing a privilege that is unsupported because of your pardon,” Paul said, “this committee has scheduled a vote next week on a resolution certifying your contempt.”

Whether that vote succeeds is one question. Whether it changes anything is another. Fauci has weathered plenty of Washington storms before, and a contempt citation, however dramatic, doesn’t put him in a courtroom on its own — it puts the matter back in Congress’s hands, where it has stalled more than once already.
